Colaburation and capital gain tax


I had got into a colaburation with builder in 2010. On my land .He constructed basement +stilt parking +ground floor +1st floor +2 & 3rd floor. He also gave some cheque to me. As per our agreement the builder got 1st floor plus the 22.5% land share.
Now due to some financial crisis I wish to sell my 2nd floor in 2023.
Will I get the benefit of cost of construction in the indexation ?
The cost of construction can be the area of the floor multiply by the then circle rate.
Can any learned Tax Lawyer or CA help me.
