Form GST PMT-09 and its effective date?


Form GST PMT-09 has been enabled on the GST Portal for transfer for cash ledger balance from one head to other head by taxpayers. But surprisingly its corresponding rule i.e. Rule 87(13) of CGST Rules is still not effective? Rule 87(13) has been inserted by Central Goods and Services Tax (Fourth Amendment) Rules, 2019 vide Notification No. 31/2019 – Central Tax dated 28.06.2019, the relavent portion of which is read as below:

after sub-rule (12), with effect from a date to be notified later, the following sub-rule shall be inserted, namely:-

“(13) A registered person may, on the common portal, transfer any amount of tax, interest, penalty, fee or any other amount available in the electronic cash ledger under the Act to the electronic cash ledger for integrated tax, central tax, State tax or Union territory tax or cess in FORM GST PMT-09.”

But it is important to note here that Rule 87(13) has been neither made effective vide above notification nor by any subsequent notification issued thereafter. Therefore the legal validity of Form GST PMT-09 being filed before any such notification is still in question? A suitable notification for notifying its effective date is still awaited. Therefore tax profeesionals are kindly advised not to rush and kindly wait for a suitable notification before filing the Form GST PMT-09 on GST Portal. 

Nevertheless, below is the process flow to file Form GST PMT-09?

1. Go to Electronic Cash Ledger

 

2. Cash ledger balance available for transfer will be displayed as below.

 

3. Transfer cash balance to any ledger and click save and proceed to file.

This is to address query of many people.

Notification No. 71/2019 notifies effective date only for rule 5 of CGST 4th Amendment Rules, 2019 notified vide Notification No. 31/2019.

And Rule 5 of CGST 4th Amendment Rules, 2019 amends only Rule 46 of CGST Rules 2017. Therefore the above notification does not notify effective date for Rule 87(13) of CGST Rules 2017.

This is very good system to transfer the excess SGST or IGST or CGST which will help traders to utilise unused amount to any payable amount.
